(New York, NY) -- Katherine Heigl is taking a New York pharmacy to task for using a paparazzi photo in its advertising. The former "Grey's Anatomy" star has filed a six-million-dollar civil lawsuit against Duane Reade in federal court in New York. In her complaint, Heigl says the drug store posted an unauthorized photo of her on its Twitter and Facebook account with captions advertising the pharmacy. The actress says she was photographed by paparazzi near a Duane Reade store in New York in March. Heigl is promising to donate all proceeds from the lawsuit to a foundation launched in the name of her late brother, Jason Debus Heigl, who was killed in a car accident in 2008.
